Terms and Conditions

These terms and conditions govern your use of the FernHouse NZ website (fernhouse.co.nz) and the purchase of products through our store. By placing an order with FernHouse NZ, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not place an order.

1. About Us

FernHouse NZ is a New Zealand-based online retailer offering curated home, lifestyle, and wellness products. Our registered address is Kumeu, Auckland, New Zealand. You can reach us at support@fernhouse.co.nz.

2. Consumer Guarantees Act 1993

All goods sold by FernHouse NZ come with guarantees under the Consumer Guarantees Act 1993 that cannot be excluded or limited by contract. Under this Act, you are entitled to expect that goods:

Are of acceptable quality (safe, durable, free from defects, and acceptable in appearance and finish)
Are fit for the particular purpose you made known to us at the time of purchase
Match their description on our website
Match any sample or demonstration model provided
Are owned by us and not subject to third-party claims

If goods fail to meet these guarantees, you are entitled to a remedy. For minor failures, we may choose to repair or replace the goods, or provide a refund. For major failures, you may choose a replacement or a full refund. These rights are in addition to any other rights you may have under law.

3. Fair Trading Act 1986

FernHouse NZ is committed to honest and transparent trading. We do not make misleading or deceptive representations about our products, their features, or their pricing. Product descriptions and images on our website are provided in good faith and are as accurate as we can make them. Colours and textures shown in product images are representative and may vary slightly due to differences in screen settings and lighting conditions.

4. Pricing and GST

All prices on our website are in New Zealand Dollars (NZD) and include 15% Goods and Services Tax (GST). We reserve the right to change prices at any time without prior notice. However, if you have completed an order and received a confirmation email, your order will be fulfilled at the price shown at checkout. Shipping costs, where applicable, are displayed separately at checkout.

5. Order Process

When you place an order on our website, you are making an offer to purchase the items in your cart at the prices shown. Your order is not accepted until we send you an order confirmation email. We reserve the right to decline any order at our discretion, for example if a product is out of stock, if we are unable to verify payment, or if we suspect fraudulent activity. If we decline your order, any payment taken will be refunded in full.

6. Payment

Payments are processed securely through Stripe. We accept Visa, Mastercard, and American Express. All transactions are encrypted using SSL technology. FernHouse NZ does not store your credit or debit card details at any time. Stripe is a PCI-DSS Level 1 certified payment processor.

7. Delivery

Products are shipped from our supplier’s warehouse in China via CJPacket Sensitive tracked courier. Estimated delivery time to New Zealand addresses is 6 to 10 business days from the date of dispatch. Please note:

Delivery timeframes are estimates, not guarantees
We are not liable for delays caused by customs, courier services, weather events, or other circumstances beyond our control
Orders are processed within 1 to 3 business days of payment being received
A tracking number will be emailed to you once your order has been dispatched
We currently ship to New Zealand addresses only

8. Risk and Title

Risk of loss or damage to goods passes to you upon delivery to your nominated address. Title to the goods passes to you once full payment has been received and cleared.

9. Intellectual Property

All content on the FernHouse NZ website, including text, images, logos, and product descriptions, is owned by or licensed to FernHouse NZ. You may not reproduce, distribute, or use any content from our website without our prior written consent.

10. Limitation of Liability

To the extent permitted by law, and subject always to our obligations under the Consumer Guarantees Act 1993, our liability to you in connection with any order is limited to the purchase price of the goods in that order. We are not liable for any indirect, incidental, or consequential loss or damage arising from your use of our website or products.

Nothing in these terms limits or excludes any rights or remedies you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

11. Dispute Resolution

If you have a concern or complaint about a product or your order, please contact us first at support@fernhouse.co.nz. We are committed to resolving disputes fairly and promptly.

If we are unable to resolve a dispute directly, you have the following options:

Disputes Tribunal: For claims up to $30,000, you can apply to the NZ Disputes Tribunal, a low-cost and accessible forum for resolving civil disputes
Commerce Commission: For concerns about misleading conduct or unfair trading practices, you can contact the Commerce Commission at comcom.govt.nz
NZ courts: These terms are governed by the laws of New Zealand, and any disputes that cannot be resolved through the above channels are subject to the jurisdiction of New Zealand courts

12. Changes to These Terms

We may update these terms and conditions from time to time to reflect changes in our business practices or legal obligations. The current version will always be available on our website. Your continued use of the FernHouse NZ website after any changes have been posted constitutes your acceptance of the updated terms.
